These Terms of Service ("Terms") govern your access to and use of the Spritz Bot service ("Service"), including the Discord bot and the website at spritzbot.it, operated by the Spritz team ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use this Service, in accordance with Discord's Terms of Service. By using Spritz, you represent that you meet this minimum age requirement. Users in the European Union must be at least 16 years old, or have obtained verifiable parental consent, to use services that process personal data.

2. Use of the Service

You agree to use the Service only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations. Specifically, you agree not to:

  • Use the Service to harass, abuse, or harm others
  • Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure
  • Use automated scripts or bots to interact with the website (other than the Spritz bot itself)
  • Distribute spam, malware, or any harmful content through the bot
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Reverse-engineer or decompile any part of the Service
  • Violate Discord's own Terms of Service while using Spritz

3. Server Administrator Responsibilities

If you add Spritz Bot to a Discord server, you are the server administrator and are solely responsible for how the bot is configured and used within your server. You agree to:

  • Only add Spritz to servers where you have the necessary permissions to add bots
  • Configure the bot's features in compliance with Discord's Community Guidelines
  • Not use the bot to facilitate illegal activities, harassment, or hate speech
  • Inform your server members about the data Spritz collects where required by law

4. Intellectual Property

All content on the Spritz website, including text, graphics, logos, and software, is the exclusive property of the Spritz team and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this site without our prior written consent.

5. Availability and Modifications

We strive to provide a reliable service, but we do not guarantee uninterrupted availability. We reserve the right to:

  • Modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice
  • Change features, pricing (if applicable), or functionality at our discretion
  • Perform maintenance that may temporarily interrupt the Service

We will make reasonable efforts to notify users of significant changes via our Discord support server or website announcements.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the Spritz team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from the use of the Service shall not exceed €100.

8. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, if we determine that you have violated these Terms or engaged in conduct that is harmful to other users, the Service, or third parties. Upon termination, your right to use the Service ceases immediately.

9. Third-Party Services

The Service integrates with third-party platforms including Discord and Google. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for the practices of those third parties.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Italy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
